Status of federal lawsuit against Cotter on city council agenda

The Cotter City Council members will receive a status report on a lawsuit filed almost a year ago in federal court against the city during its regular September session Thursday evening at 6:00.John Wilkerson, attorney for the Arkansas Municipal League, is set to address the council regarding the suit by Twin Lakes Recovery Center of Northern Arkansas, one of a series of state-wide community based re-entry facilities.

TLR filed suit in November 2017 saying the City of Cotter violated the federal Fair Housing Act when it terminated its occupational permit. City officials said TLR did not request the permit until after it had opened. As a result, city officials contended the facility had opened without notification to surrounding residents of its existence.

In other business, Mayor Peggy Hammack says she will ask the council to set the city’s tax levies to be collected in 2019 at their current rates, 5 mills for the general fund and 4 mills for the fire department.

Also under new business, a Waste Connection rate increase will be announced.

The council will also consider a resolution to apply for a USDA grant for the sewer lift station, as well as the selling of a 1975 water truck.

Under old business, the council will place ordinances on second reading to amend the police department’s K9 policy and the municipal code.

The meeting will be held in the council chambers of Cotter City Hall.
