A Boone County man, 57-year-old Elton Jones, remains incarcerated following an argument with his wife that led to her being shot.
According to the probable cause affidavit filed Monday, an investigator with the Boone County Sheriff’s Office was notified of a suspected shooting at a residence along Pine Crest Drive in Omaha on March 29.
The investigator arrived to find the victim with what appeared to be a gunshot wound under her left breast and an exit wound on her lower back near her spine.
The woman said she and her husband had been arguing when she stepped outside to calm down. She said she was on the front porch when Jones handed her a pistol he had retrieved inside the residence.
She said Jones had his finger on the trigger when he handed the weapon to her, and it discharged.
Jones offered another version of the incident, saying his wife was upset and went outside to shoot the weapon to calm down. He said his wife walked across the yard, turned around and stepped onto the front porch. He said he heard a gunshot, and his wife fell back saying she could not breathe.
In an interview at the Boone County Detention Center, Jones said he handed the weapon to his wife, and it went off. He said he attempted to render aid and called 911. He said he knew he was prohibited from possessing firearms and was scared he would be in trouble.
The investigator noted he believes Jones committed the offense of attempted second-degree murder when he retrieved the weapon from inside the house after arguing with the victim. He said it appears from evidence at the scene the victim was attempting to leave the residence when Jones stepped out of the house and fired one round from a .9mm semi-automatic pistol.
Jones has been charged with first-degree battery, a Class Y felony, and possession of firearms by certain persons, meaning he is a convicted felon. Class Y felonies are the most serious classification of crime in Arkansas not punishable by death.
Bond for Jones was set at $500,000.
