Cabot pool company sued; owners allegedly cost consumers $415,200

LITTLE ROCK, Ark. — A lawsuit has been filed by Arkansas Attorney General Leslie Rutledge against Dewayne Boswell, Austin Logan and Ultimate Builders, LLC for violating the Arkansas Deceptive Trade Practices Act (ADTPA). The complaint alleges Logan, Boswell and companies advertised and accepted money from 17 Arkansans to install in-ground swimming pools, which they failed to complete and provide the promised services and goods, costing homeowners $415,200. The men also did business under the names Ultimate Pool Construction, Logan Pool Construction, UC Lawns and Ultimate Decks. The lawsuit was filed in Lonoke County Circuit Court.

“These cons took money from families who had saved for years to have their dream backyard,” said Attorney General Rutledge. “Logan and Boswell accepted tens of thousands of dollars from those families only to leave them with empty dreams and large empty holes in their yards.”

Attorney General Rutledge alleges that the defendants knowingly made false representations to consumers, claiming that Ultimate Builders would install the pools within 90 days; however, after obtaining money from customers, construction would cease on the projects, leaving many Arkansans with nothing more than holes in their backyards. Logan violated the ADTPA when he lied to consumers, by saying that he was licensed through the Arkansas Contractors Licensing Board when he was not. He also lied to consumers saying he was insured when he was not. The use of multiple business names further increased the consumer confusion created by these lies.
