Father and son face rape charges

A 75-year-old Mountain Home man and his 41-year-old son are both facing accusations of rape. The son appeared in Baxter County Circuit Court recently and entered a not guilty plea to his charges.

The father, David White,Sr., is also charged with sexual assault, sexual indecency with a child and sexual grooming. The violation date on his initial charges is shown as July 15, 2022.

Court records show the second set of Baxter County charges were filed in late January.

The elder White has also entered not guilty pleas to his charges.

In Marion County, the father is also facing two counts of rape and eight counts of sexual assault. The violation date in that case is listed as early June 2007.

The son, David White, Jr., is charged with three counts of rape with a violation date listed as November 21 last year. He was recently returned to Arkansas from Illinois.

David White, Sr. who lists an address along Baxter Avenue is free on bond. The son was arrested in Oregon, Ill., where he listed an address along Lover’s Lane and extradited to Arkansas.

The younger White is being held in the Izard County jail because of security concerns.

The bond for David White, Jr., is set at $250,000.

On a motion by the elder White’s attorney, Ben Burnett of Mountain Home, the court ordered a psychological evaluation to determine his fitness to proceed in the case against him, and to determine if he can be held criminally responsible for his acts.

Burnett indicated White’s defense would be based on mental disease or defect.

After psychological evaluations were ordered, all activity in the elder White’s initial case stopped until reports on the evaluations are received.

The reports were returned April 4, according to electronic court records.

Information, such as that contained in probable cause affidavits, has been sealed by the court in the cases involving both father and son.
When the charges were originally filed, a spokesman for the Baxter County Sheriff’s Office indicated the offenses in the father’s case had allegedly occurred over a 10-year period.

In addition to the criminal charges, several domestic relations cases have also been opened involving the two men.

The cases dealt with divorce, petitions for orders of protection and one suit filed to establish paternity.
