Izard County child porn suspect allowed to work in Florida while awaiting trial

A man from Arizona who was living in Izard County when he was indicted for distribution of child pornography, will be allowed to travel to Florida to work on a construction site with his father while he awaits trial. The Arkansas Democrat-Gazette reports a magistrate judge approved the release plan.

Forty-year-old Jonathan Waters of Flagstaff, who was living with his mother and stepfather in Brockwell, was indicted by a federal grand jury in Little Rock in June. The indictment was related to a video showing a minor involved in explicit sexual conduct.

Court records indicate the FBI received notice from the National Center for Missing and Exploited Children of child sexual abuse material that had been uploaded to an app called KIK. The IP address was traced to the home where Waters was staying in Izard County. A search of Waters’ phone found 15 child porn videos that had been uploaded to the app.

Records indicate in June, Waters went before U.S. Magistrate Judge J. Thomas Ray with a plan to have his girlfriend serve as his third-party custodian, to ensure he appeared at his court dates and complied with his pre-release requirements. The judge, citing Waters’ four previous domestic battery convictions, including one involving his own children, denied the request.

At a later hearing, the judge allowed Waters’ father in Venice, Florida to be responsible for him. Waters will work at a construction site in Orlando, but otherwise, cannot leave his father’s house except for certain circumstances.

His next court date is Dec. 18 in U.S. District Court in Jonesboro.
