A Boone County man charged for allegedly firing gun towards neighbor in altercation

A Boone County man has been charged after allegedly firing a gun towards his neighbor after his dog got loose and tried to attack her dog.

According to the probable cause affidavit, on Oct. 27, Harrison Police Department officers responded to a report of “shots fired” at a location along Cedar Ridge Road. Upon arrival, the victim told authorities a man, identified as 20-year-old Denver Garcia, allegedly fired a gun at her while driving off in his car. She stated the incident began when Garcia’s dog got loose from his yard, ran into hers and tried to attack her smaller dog. She reported she was able to intervene while Garcia retrieved his dog before anything happened.

The victim told officers Garcia got into his vehicle with a woman and started “talking smack” She reported told him “People usually say sorry when their dog gets loose.” It was at that time Garcia allegedly pulled out a gun and fired in her direction before speeding off.

While on the scene, officers located and collected a shell casing in the street near where the victim reported the incident. They were also able to locate a spent slug buried approximately an inch into the dirt in the front yard of the house next door.

Moments after leaving the scene, Garcia was stopped by officers and taken into custody. At the time of his arrest, a handgun was also seized.

During a recorded post Miranda interview, Garcia reported his dog got loose and ran into the neighbor’s yard. After he got his dog, he stated he and his wife went to get coffee. While he was leaving, Garcia confirmed the victim’s statement to him, and stated he thought Arkansas was a “Stand Your Ground” state and pulled out his handgun where the victim could see it. He said the victim continue to come towards him within arms-length of his car when he fired off a warning shot into the dirt. Garcia claimed he did not fire in the direction of the victim. He admitted he drove from the scene and stopped when he say the first police car.

Garcia was charged with one felony count of unlawful discharge of a firearm from a vehicle and was cited with discharging a firearm within the city limits. He was booked and released from the Boone County Detention Center on a $5,000 bond.
