Lawsuit between Baxter County Airport and the county on hold until December 18

The lawsuit filed last month by the Baxter County Airport Commission against Baxter County and Baxter County Judge Kevin Litty has been put on hold until Dec. 18 after legal counsel for each side met with the judge Wednesday.

According to online court documents in the case, the parties appeared with their attorneys and a hearing was held. The counsel for the parties agreed that legal arguments would be presented in the form of further pleadings. The county will file their answer to the airport commission’s complaint, at which time the airport commission will have 10 days to respond to the statements made. The county will then have 10 days to respond. Counsel for both sides will let the court know when they are ready to proceed.

The temporary restraining order issued Nov. 4 by Circuit Judge Andrew Bailey to prevent the Baxter County Quorum Court from approving Litty’s proposal for a hanger lease remains in place until further orders from the court.

The airport commission filed the lawsuit Oct. 28.
