Timothy Liveley of Mountain Home, who entered a guilty plea to charges stemming from his threat to burn his mother’s house and was given five years probation in late August, was back in Baxter County Circuit Court Thursday charged with violating the terms and conditions of his probation.
A petition to revoke his suspended sentence was filed in early September alleging the 38-year-old Liveley never showed up for his initial intake session with parole and probation officers and avoided all contact with the Arkansas Department of Community Corrections.
The revocation was amended to the lesser charge of contempt of court and Liveley was sentenced to 89 days in the Baxter County jail with credit for time served. Liveley was originally booked into the jail on the charge Nov. 10th. He will be allowed to do his time on weekends so he could remain gainfully employed.
According to the probable cause affidavit in the original case, Liveley and his girlfriend came to his mother’s house in early August. While at the residence, Liveley was said to have become angry, cursed his mother and made other threats. At one point, Liveley threw a sleeping bag under the mother’s vehicle and told her he was going to set it on fire and then burn her house down.
The mother reported Liveley and his girlfriend eventually left her home. Liveley sent his mother a text message after leaving threatening to have someone assault her.
When arrested, Liveley was reported to have been hiding in a bedroom at the girlfriend’s residence.
