A man found in possession of small amounts of heroin and marijuana entered a guilty plea to the charges against him during a session of Baxter County Circuit Court Thursday and was sentenced to three years probation.
Twenty-nine-year-old John Peyton Schmidt, who lists a Fayetteville address, was arrested in early July. The incident began when a female called the 911 center and reported the occupants of a black SUV had thrown bottles and cups at her vehicle.
U.S. Army Corps of Engineers rangers located the vehicle in a parking area at Pigeon Creek park. Schmidt, the driver, denied throwing bottles and cups but did admit he had “flicked a cigarette” at the woman’s car.
The rangers discovered Schmidt was on probation with an active search warrant on file, and he reportedly also told the rangers he had no problem with them searching his vehicle.
It was during the search the heroin and marijuana were discovered in the vehicle, and Schmidt was placed under arrest.
Schmidt was charged with one count of felony possession of a controlled substance and two misdemeanor counts of possessing drugs and drug paraphernalia.
