
On February 20, 2022, a naked man who had attempted to kick in the front doors of three homes was arrested.
Forty-four-year-old Nicholas James Foti’s case was dismissed by the state during a session of Baxter County Circuit Court Monday (February 10).
When Deputy Prosecutor Cole Ezell announced to the court that the case was being dropped, he said Foti had sold his residence and left the area.
Circuit Judge John Putman commented “so that’s a reason to dismiss a case?”
Foti has listed an address in Thousand Oaks, Calif., on some of the early court documents in his case.
He was arrested after Mountain Home police responded to reports of a naked man trying to force his way into homes in an area along Fuller Drive and Ivy Lane.
Police reported finding Foti unclothed and lying on the ground.
One victim told police Foti had tried to get into his home, but he was able to lock the door. He said he armed himself and followed Foti to his next target.
He told Foti to stop what he was doing. Foti spotted the weapon the victim was carrying and taunted, “ain’t nothing but a cap gun and I’m going to take it away from you.”
The victim said Foti then charged at him and he fired a warning shot. After figuring out the weapon being carried by the victim was no cap gun, Foti quickly gave up, went to the ground and stayed there until police arrived and cuffed him.
He was charged with three counts of criminal intent to commit residential burglary and indecent exposure.
